These Terms of Service ("Terms") govern your access to and use of the Winmov website, products, and services (collectively, the "Service") provided by Winmov ("we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

1. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. When you create an account, you agree to provide accurate and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2. Use of the Service

Winmov provides tools to generate and manage AI-powered images and videos from your prompts, uploads, and other inputs ("User Content"). You are solely responsible for the content you submit and any outputs you generate, including ensuring that your use of the Service complies with all applicable laws, regulations, and platform policies (such as those of YouTube, TikTok, Instagram, and other distribution channels).

You agree not to use the Service to create or distribute content that is illegal, harmful, hateful, harassing, infringing, misleading, or that violates the rights of any third party. Winmov may, at its sole discretion, suspend or terminate accounts that violate these rules.

3. AI-Generated Content and Responsibility

Outputs generated by the Service are created by AI models based on your inputs and settings. While we aim to provide high-quality results, AI outputs may be unexpected, inaccurate, or unsuitable for certain contexts. You are responsible for reviewing and vetting all outputs before using them in any personal, commercial, or public context.

You are solely responsible for obtaining any necessary rights, licenses, or consents for fonts, logos, trademarks, likenesses, or other materials that appear in your inputs or outputs.

4. Credits, Fees, and Payments

Access to certain features of the Service may require the purchase of credits or subscription plans. Prices, credit consumption rates, and available plans are described on the pricing page and may be updated from time to time.

Payments are processed by third-party providers (such as payment processors or app stores). By making a purchase, you agree to their terms and any applicable fees or taxes. Refund eligibility is described in our Refund Policy. We may offer free trials or promotional credits at our discretion.

5. Intellectual Property

Winmov and its licensors own all rights, title, and interest in and to the Service, including the software, models, interfaces, designs, and branding. These are protected by copyright, trademark, and other laws.

Subject to your compliance with these Terms and applicable law, you generally own the rights to the outputs you generate from your lawful inputs, to the extent permitted by law and by any third-party terms that apply. Winmov may use aggregated, anonymized, or de-identified data to improve the Service and underlying models.

6. Prohibited Activities

You agree not to:

• Use the Service for any unlawful, defamatory, or fraudulent purpose.
• Attempt to reverse engineer, decompile, or otherwise extract source code, models, or underlying systems.
• Bypass, interfere with, or attempt to circumvent any usage limits, security features, or content filters.
• Misrepresent outputs as entirely human-created when disclosure is required by law or platform policy.

7. Third-Party Services

The Service may integrate with or link to third-party services such as payment processors, cloud storage providers, analytics tools, and identity providers (for example, Google or WeChat). Your use of those services may be governed by separate terms and privacy policies, and Winmov is not responsible for their actions or content.

Winmov is an independent product. References to third-party model names in the Service or documentation are for descriptive purposes only and do not imply affiliation, endorsement, or sponsorship by the model providers.

8. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe that you have violated these Terms, are causing harm to the Service or other users, or for security or legal reasons. You may stop using the Service at any time.

9. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Winmov and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of or in connection with your use of the Service.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which Winmov is organized, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for the resolution of any disputes arising out of or relating to the Service or these Terms.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after any changes become effective will constitute your acceptance of the revised Terms.
